General terms of use for the Feelgood mobile application, the "Feelgood app"

These Terms of Use (the "Terms") apply between Feelgood Företagshälsovård AB, reg. no. 556185-6385, ("Feelgood" or "we" in any form) and you as a user (the "User" or "you" in any form) of the Feelgood app (the "App") including the Services and Functions described in these Terms. In order to use the App, you must accept these Terms upon logging in, which means that you enter into an Agreement with us. Therefore, it is important that you read the Terms carefully. By entering into an Agreement with us, you confirm that you have read, understood and accepted the Terms.

We constantly work with improving our offers and with developing new Services and Functions in the App. The scope and contents of the Services and Functions in the App may therefore be subject to change. This may cause changes to this Agreement. In such cases, we will ask you to accept our updated Terms before you can use the App, as a logged-in User, again.

1. The Services and Functions of the App

While you are logged in, the App works as the central place for your personal contacts with Feelgood. The type of contact you have with Feelgood depends on where you work, where your partner works, but also on your own choices. If you have gained access to the App you can continue to use it even if you no longer receive occupational health care from Feelgood through your employer, but without having access to all Services and Functions. (If you are a manager or work in the HR department of an organization which has an agreement with Feelgood, please continue reading at the bottom of this page.)

Some Services and Functions become activated immediately upon logging in, while others are activated by you after you log in. You may also deactivate the Services you have activated yourself.

Services and Functions that are activated for all Users directly upon logging in:

  • Self-assessment tests (e.g. about alcohol habits and fatigue)

Services and Functions which you may access through your employer, and which in such a case are active immediately upon logging in:

  • In-app Remote Service Platform - Secure message and video exchange with health care professionals working with occupational health care. The platform is made available via an in-app browser
  • Appointments - Information regarding appointments with us as an occupational health care provider. You may also cancel or reschedule  appointments via the App.
  • Frisklinjen - Sick leave notification and medical advice
  • Find us - Search function to find one of Feelgood's occupational health care units

Services and Functions that you can access through your employer or through your partner, but which you must choose to activate (and which you can also switch off):

  • Feelgood Plus - Private Health - Digital healthcare services and quick access to orthopedic surgery for yourself, your children under the age of 18 years and a partner. For Feelgood Plus, there are specific Terms of Use that you need to approve in connection with activation. You may read them now if you want to.
  • Vaccinations - If you select to activate the service in the App, you will be able to access the information and other associated services relating to vaccinations, as specified in the App.

2. Our information about you

Only registered users can log in to the App. You are a registered user of Feelgood if we have received information from your employer or your partner that you have the right to use any of our Services, or if you have received a company-specific activation code from your employer. If you have started to use the App we will not de-register you even if you no longer receive occupational health care from Feelgood through your employer. We would like to inform you that we may give employers who have agreements with us the opportunity to confirm that people who have entered their activation codes are employed by them. If you notice that information regarding the identity of your employer is incorrect, you should contact your employer or your previous employer in order to update your employment information. They should then in turn notify Feelgood.

The information we potentially have about you - for example, regarding appointments with Feelgood occupational health care, sick leaves or care of a sick child (Swedish: VAB), or a survey questionnaire to fill in - is information we store in our capacity as an occupational health care provider to your employer. This information is not stored in the App itself, but you can access the data through the App if you are logged in.

Information about vaccinations is retrieved from Feelgood's patient record system (if you select that option in the App) and you may also register information about other vaccinations via the App. Vaccination information you register is kept in a separate register and does not become part of your patient records.

In addition to the contact information Feelgood has received from your employer, you may also register an email and a mobile number via the App. This contact information is not used by Feelgood when providing occupational health care services but it may be used in connection with information about and services in private health offered by Feelgood.

3. Provision of Services and Functions

The Services and Functions of the App are provided in accordance with the Agreement, as well as in accordance with applicable legislation and regulations. You may yourself activate or deactivate certain Services and Functions within the App. 

Feelgood strives for the App to have high availability. The goal is that you shall be able to use the App and log in at all times of the day, on all days of the year. However, unforeseen interruptions or planned interruptions in the form of maintenance may occur. We do not guarantee continuous, uninterrupted or secure access to the App or the separate Services or Functions within the App.

Moreover, we are not responsible for the content, functionality and accessibility of websites to which there are links in the App or for third party data. Furthermore, we are not responsible that the information you register into the App is correct. 

Content published in the App complements the medical advice provided by health care providers and is not intended to be used instead of a physician's assessment, diagnosis or treatment for any illness.

If you have access to the Services and Functions in the App through your employer or your partner's employer, the access will end as soon as the relevant employer's Agreement with Feelgood ends or as soon as Feelgood is informed of the termination of the employment (your or your partner's) on which our commitment is based. 

4. Information from Feelgood

Feelgood may send you information about services, tips and advice regarding your private health. Information is only sent to your contact information that you yourself have registered in the App.

5. Intellectual property rights

All intellectual property rights used in, incorporated in, or provided through the App, such as copyrights, inventions, designs, trademarks, company names and know-how, and other rights, materials and data therein, including documents, registry information and the like, including these Terms, belong to Feelgood or a third party. If and when the App uses third party intellectual property rights then Feelgood uses such material under a license issued by the intellectual property rights owner. 

Copying, modifying, processing, leasing, transferring and / or other use of intellectual property or material, made available via the App, which is not expressly permitted under these Terms, is strictly prohibited. 

For your information: All the intellectual property rights of the In-app Remote Service Platform and content of the platform, the layout of the platform and any material relating to the platform belong to the Suomen Terveystalo Oy (Finnish business ID 1093863-3) or a third party. For the avoidance of doubt, Suomen Terveystalo Oy is a supplier to Feelgood and has no liability or any other obligations towards the User.

6. Your obligations

When using the App, you must:

  • always provide correct information and use your correct identity;
  • upon suspicion that any other person has access to your App account, immediately act to limit such person's access to the App and promptly inform Feelgood thereof by e-mailing tekniksupport@feelgood.se;
  • not share or upload information that is illegal or otherwise inappropriate;
  • take reasonable measures to ensure that the materials uploaded by you contain no malware and are not harmful in any other way; and
  • not use the App (and its Services or Functions) in a manner that is not intended or otherwise risks causing damage to Feelgood or Feelgood’s business partners. 

Feelgood may at any time control and investigate that you adhere to the obligations stated above or that you otherwise act in accordance with this Agreement. Any use of the App contrary to your obligations or using the App in an unauthorized manner or otherwise in breach of this Agreement will be considered as misuse. If you misuse the App, then Feelgood may immediately restrict or suspend your access to the App. 

If the User misuses the App or otherwise is in breach of this Agreement or applicable legislation then the User is liable to indemnify Feelgood for all damages suffered by Feelgood (including but not limited to attorney's fees, cost of court proceedings and all third-party claims).

7. Term and termination

The agreement is valid until further notice. Users are always entitled to terminate the Agreement with immediate effect by notifying Feelgood, whereby Feelgood then shall delete information that is related to or registered by the User when using the App.

Feelgood has the right to terminate the Agreement with immediate effect if the User breaches or may be suspected of breaching this Agreement and does not remedy the situation within thirty (30) days from when a written request to do so was made to any email-address registered in the App or via regular mail. In the event of such a termination, the account will be cancelled and information provided by the User and stored in the App will be removed promptly, after which the Agreement will automatically expire. Users who have been cancelled from the App in accordance with this paragraph are not entitled to re-register or register a new account without explicit permission from Feelgood.

8. Transfer restriction

You do not have the right to assign or transfer your rights and obligations under the Agreement. Feelgood, on the other hand, has the right to transfer all or part of its rights and obligations under the Agreement.

9. Reports of errors and liability

If you are of the opinion that there are errors in the App, please notify us as soon as possible with a clear description of how the error manifests itself. A Service or Function may be deactivated for the User (or all Users)  during the time of the troubleshooting. Reports of errors are made to tekniksupport@feelgood.se

Feelgood shall not be liable for any damages arising in connection with use of the App, except if the damage has been caused by Feelgood's gross negligence or intent.

10. Dispute resolution and applicable law

Disputes concerning the application and execution of the Agreement shall be interpreted in accordance with Swedish law and shall be settled by a general court in Sweden.

11. Processing of personal data

Feelgood will process your personal data in accordance with Feelgood Group's Privacy Policy

 

This is an inhouse translation. In case of any conflicts between this translation and the Swedish version, the Swedish version shall prevail

For managers / HR in an organization with an agreement with Feelgood

The Feelgood app contains no Functions and Services that are tailored for you who are managers or HR of an organization for which Feelgood is an occupational health care provider. Instead, you should activate your account at Feelgood’s web portal at kund.feelgood.se to access Functions and Services that are of interest to you, such as ordering, time booking, invoice documentation, documentation for the application for rehab support etc. Note that these may not be activated for your company or that your company has not informed us that you should have access to the web portal. Please contact HR at your company if you have any questions.
